This month we have seen some very large fines handed out for OH&S incidents all of which have taken place prior to the harmonisation legislation coming into effect and from what we are hearing, these levels of fines are only going to get bigger under the new legislation.
We hope that your OH&S procedures comply to the new legislation but as per the newsletter article about Visy below, just having the systems isn't enough. Focus on the basics and ensure the workers know what the correct OH&S procedures are as the employer is required to take all reasonable steps to ensure that the procedures are followed.

John Holland fined almost $250,000 over worker death
The Federal Court has imposed the maximum civil penalty of $242,000 on a company that lost a worker in Western Australia's Pilbara region.
Wayne Moore, 45, an employee of John Holland Pty Ltd, died after he stepped onto an unsecured sheet of grid mesh and fell 10 metres to the floor below at BHP Billiton's Mt Whaleback mine at Newman on March 19, 2009. |

Judge says "paper safety systems are worthless", Visy fined $170k
A NSW employer has been fined $170,000 after a failure to enforce its "well-documented" maintenance procedures left two employees with serious and extensive chemical and thermal burns.
In February 2008, two Visy Pulp and Paper Pty Ltd employees were performing maintenance on a section of plant used to process raw wood chips into pulp, when they were engulfed by hot steam and a corrosive bi-product known as "black liquor". |

Court upholds sacking of "aggressive" employee after workers' comp
An employer who sacked an "aggressive" worker shortly after he returned from workers' compensation leave was justified in the dismissal, but wrong to dock his pay, a Federal Magistrate has found.
The worker, employed by a NSW glazier business known as Pane In The Glass, injured his hand two weeks after starting work in July 2011. |
